Ontario Tribunal

The Social Justice Tribunals of Ontario (SJTO) encompass a variety of different Tribunals, each acting within their own specialty, and area of law. A proceeding in a Tribunal is less formal, and in many cases, less costly than in a Court proceeding. Tribunals provide a fair and accessible forum for conflict resolution.

The SJTO Tribunals include but are not limited to the following:

Small Claims Court

The Small Claims Court in Ontario hears matters related to civil disputes where there is a monetary amount being claimed that does not exceed $25,000.00. The Small Claims Court hears a wide range of disputes that fall in many different categories. A few examples include: contract disputes, goods and services, and even employment matters.

The Small Claims Court offers accessible justice to individuals that have minor disputes with monetary remedies. The process often encourages settlement at the outset of a claim for more time efficient results. Employment Law Matters

Employment law, employee rights and employer responsibilities, are determined and governed by various legislative Acts and bills and enforced by a variety of courts and tribunals specific to the type of matter, and subject to the classification of employment (i.e. employee, contracted worker, construction worker etc.)

Provincial Offences

Occupational Health & Safety Act

The Occupational Health and Safety Act provides the legal framework and the tools to achieve this goal of making Ontario's workplaces safe and healthy. It sets out the rights and duties of all parties in the workplace. It establishes procedures for dealing with workplace hazards and it provides for enforcement of the law where compliance has not been achieved voluntarily by workplace parties.

Employers should note that the Act makes it clear that the employers have the greatest responsibilities with respect to health and safety in the workplace. However all workplace parties have a role to play to ensure that health and safety requirements are met in the workplace. All workplace parties have a responsibility for promoting health and safety in the workplace and a role to play to help the workplace be in compliance with the statutory requirements set out under the Act. The respective roles and responsibilities for all workplace parties are detailed in the Act. This is the basis for the internal responsibility system.

Highway Traffic Act

As a driver in Ontario, you are governed by the Highway Traffic Act (HTA), and as such must adhere to strict rules of the road. We understand that a rushed day getting to the office may result in a speeding ticket which seems harmless. However, those minor tickets can add up, and as fines increase and the demerit points accrue, your insurance will be negatively affected.

Employment Standards Act

The Ministry of Labour, through the Employment Standards Act, enforces and promotes awareness of employment standards, such as minimum wage, hours of work, public holidays, termination pay, severance pay and other standards.

ALTERNATIVE DISPUTE RESOLUTION

Alternative Dispute Resolution (ADR) is a form of conflict resolution where the parties avoid lengthy and expensive litigation in the court system. ADR allows parties to address their conflicts, outline their interests and reach a decision by way of mediation, arbitration, or negotiation. All proceedings are done in an informal and confidential manner.

Commissioner for Taking Affidavits/NotARY pUBLIC

A notary public has all the powers of a commisioner for taking affadavits in Ontario, and can also witness or certify, and attest, the execution of a document, and certify and attest documents to be true copies of the original.
